Fulton County District Attorney Fani Willis is seeking to reinstate six original criminal counts against former President Trump and his co-defendants in the 2020 election case. This move comes after a judge had previously dismissed these charges earlier this year.

In a brief filed with the Georgia Court of Appeals, Willis is challenging Judge Scott McAfee’s decision to drop charges against Trump and his associates. The request aims at overturning the dismissal of these charges related to election interference.

Judge McAfee had thrown out six charges in March, citing insufficient detail in Willis’ allegations. Subsequently, two more criminal counts were dismissed last month on grounds of lacking legal authority. However, McAfee upheld the racketeering charge against all defendants involved.

Willis contests the court’s decision to quash six counts, arguing that the indictment adequately informed the defendants of the accusations, allowing them to prepare a defense effectively. She asserts that her indictment was comprehensive, providing substantial context and factual details.

Specifically targeting counts 2, 5, 6, 28, 36, and 38 in her appeal, Willis seeks their reinstatement. Interestingly, Trump’s lead defense counsel Steve Sadow rebuts these claims by asserting that the state failed to meet legal requirements regarding those dismissed counts under Georgia law.

The legal proceedings faced a setback when it emerged that Willis had been involved in an “improper affair” with Nathan Wade, a prosecutor assisting in building the case against Trump. Following this revelation, Wade resigned from his position.

Moreover, in June, the Georgia Court of Appeals halted proceedings pending a hearing concerning Willis’ disqualification—a significant obstacle for her case against Trump. The court scheduled December 5th for hearing Trump’s plea to have Willis disqualified post the 2024 presidential election.
